He's a La Jolla chopper pilot to celebrities like rocker Tommy Lee. Now David Martz is in trouble with the FAA, accused of making a porn tape as he flew over San Diego.

 

Just days ago, L.A. police officials say Martz flew dangerously close to one of their choppers as he flew with the former Motley Crue member. That's being investigated, along with an x-rated videotaped sky-high adventure featuring Martz as one of the stars.

 

The FAA is launching an investigation involving Martz, who was caught on tape engaged in sexual activity with porn star Puma Swede while the 53-year-old was at the controls, flying over the North County coast.

 

"Our safety office in San Diego is aware of the video and we're in the process of obtaining the video and we're going to investigate the behavior that is depicted on the vide," FAA spokesman Ian Gregor said.

 

The heavily edited video, shot back in 2007, surfaced on TMZ's website and shows Swede topless on the Montgomery Field tarmac. Next, she is seen in the chopper with Martz flying over La Jolla Shores at Sunset.

 

At one point, the 33-year-old x-rated performer points to a ring on Martz's hand and slaps it, an apparent reference to the veteran aviator being married at the time.

 

While Martz continues to fly, Swede becomes topless again and then he begins to grope her. Shortly after, she unzips his pants and performs a sex act on him. The video then shows the pair landing back at Montgomery Field after sundown.

 

"I think this is a case where we probably should have taken a closer look at this when we first received that information, and we are now taking that closer look. We're going to investigate these allegations thoroughly and proceed from there," Gregor said.

 

Previously, the FAA either suspended or revoked Martz's pilot license for flying recklessly or for performing an aerobatic flight too low over a populated area. There was no word yet on what, if any, action will be taken regarding this latest incident.

 

"Generally speaking, a pilot should be focusing on the act of flying and not be distracted by anything else," Gregor said.

 

David Martz did not return our phone calls, but regarding the incident, he told TMZ, "That's how we roll and it's no big deal."
